Some patios are\ngrandiose affairs costing tens of thousands of dollars and some are very\neconomical structures. Whatever the structure, there are some key issues to\nconsider when buying a residential property in WA.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">1&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; What are we talking about?&nbsp; <\/h2>\n\n\n\n<p>A\npatio is an outdoor space generally used for dining or recreation that adjoins\na residence. The focus of this article are those patios that are actually\nattached to the residence. <\/p>\n\n\n\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"740\" height=\"740\" src=\"https:\/\/www.houspect.com.au\/wa\/wp-content\/uploads\/sites\/2\/2019\/05\/1.jpg\" alt=\"\" class=\"wp-image-3614\" srcset=\"https:\/\/www.houspect.com.au\/wa\/wp-content\/uploads\/sites\/2\/2019\/05\/1.jpg 740w, https:\/\/www.houspect.com.au\/wa\/wp-content\/uploads\/sites\/2\/2019\/05\/1-150x150.jpg 150w, https:\/\/www.houspect.com.au\/wa\/wp-content\/uploads\/sites\/2\/2019\/05\/1-300x300.jpg 300w\" sizes=\"auto, (max-width: 740px) 100vw, 740px\" \/><\/figure>\n\n\n\n<figure class=\"wp-block-image is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.houspect.com.au\/wa\/wp-content\/uploads\/sites\/2\/2019\/05\/2.jpg\" alt=\"\" class=\"wp-image-3615\" width=\"659\" height=\"369\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">2 &nbsp;&nbsp;&nbsp;&nbsp; What are the regulations?<\/h2>\n\n\n\n<p>While checking with the local council is\nimportant, the general rule is that any structure attached to the house will\nrequire council approval. The building permit application process will\ngenerally require:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Formal plans to be prepared <\/li><li>Engineering sign off <\/li><li>The structure will need to be\nbuilt in accordance with the Building Code of Australia and applicable\nAustralian Standards. <\/li><\/ul>\n\n\n\n<p>In general, all of the above are relatively\neasily to achieve as long as the builder follows the required steps. That is,\nof course, if a builder actually constructs the patio. The challenge being that\nmany patios are constructed by property owners or tradesmen who may not be\naware of their construction obligations. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">3 &nbsp;&nbsp;&nbsp;&nbsp; So what are the issues?<\/h2>\n\n\n\n<p>Well-constructed patios add value to a\nproperty and provide real benefit to the property occupants over many years\nwhen they are constructed well.&nbsp; Sadly we\ncome across a number of patio issues.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3.1&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Not constructed to Code <\/h3>\n\n\n\n<p>Because patios appear to be relatively\nsimple structures there are many Bunnings warriors who feel that they can\nsimply construct a patio without a building permit. How hard can it be to put\nsome posts in the ground, rafters to the house with some tin on the roof?<\/p>\n\n\n\n<p>The Building Code is there to ensure that\nthese types of structures are structurally sound on both a sunny Sunday\nafternoon and during the midst of a violent winter storm when appropriate tie\ndowns become absolutely key to ensure you patio does not end up on your\nneighbour\u2019s roof. <\/p>\n\n\n\n<p>A quality WA Registered Builder can ensure\nthat your patio is built in accordance with the approved building permit and\nthe Building Code. Sadly, these very specific components are not always\nunderstood by the weekend warriors (or some tradesmen!)&nbsp;&nbsp;&nbsp; <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3.2&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Planning approval?<\/h3>\n\n\n\n<p>Just because a structure requires planning\napproval does not mean that planning approval has been obtained. The majority\nof WA Cities and Shires will only provide copies of building permits to the\ncurrent owners of a property and in the main these will take two weeks to\nobtain from the day an application is made. Planning approval documents will\nalmost never be provided to a building inspector undertaking pre-purchase\nbuilding inspections.<\/p>\n\n\n\n<p>Anecdotal evidence suggests that there are\na significant number of non-approved structures built in the backyards of WA\nresidential properties, built both within and outside of the requirements of\nthe Building Code.<\/p>\n\n\n\n<p>Where a structure has not been built to\nCode, the majority of structures should be able to be remediated to bring the\nstructure back into code. Where a structure has been built without a building\npermit, retrospective approval can generally be obtained by following a similar\nprocess to the planning approval process, noting that costs including potential\nremediation costs to bring the structure up to Code may be required. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3.3&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Lack of maintenance<\/h3>\n\n\n\n<p>Even if a patio has been constructed in\naccordance with a building permit that does not mean that it has not been\nmaintained such that it has retained its structural integrity. Wood decay, wood\nrot, weathering, rust and white ants can all have a significant adverse impact\non the structure. <\/p>\n\n\n\n<p>The following are some of the issues\nrecently identified during building inspections:<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"> <br>Separation of key timbers <\/h4>\n\n\n\n<figure class=\"wp-block-image is-resized\"><img loading=\"lazy\" decoding=\"async\" sizes=\"auto, (max-width: 684px) 100vw, 684px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">4 &nbsp;&nbsp;&nbsp;&nbsp; The key issue when buying a property with a patio and the WA REIWA pre purchase structural building clause<\/h2>\n\n\n\n<p>The key issue with the often used REIWA\ndrafted Australian Standard Pre-purchase structural inspection clause is that\nit can only be invoked if a structural defect is identified to the property\u2019s\nresidential building. While property buyers should seek their own legal advice,\nWA lawyers have indicated that this definition will generally exclude patios\nwhich are merely attached to a residential building. Bottom line, irrespective\nof a patio containing structural defects as a result of the original construction\nor lack of subsequent maintenance or if the patio was built without the required\nbuilding permit, it is unlikely that the standard REIWA Pre Purchase building\ninspection clause will provide the buyer with any protection.&nbsp; <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">5 &nbsp;&nbsp;&nbsp;&nbsp; Conclusion<\/h2>\n\n\n\n<ul class=\"wp-block-gallery columns-0 is-cropped wp-block-gallery-1 is-layout-flex wp-block-gallery-is-layout-flex\"><\/ul>\n\n\n\n<p>When you are looking at a property to\npurchase, have a very good look at the patio. See if you can identify any\npotential defects or maintenance issues. Ask the vendor\/listing agent if they\ncan warrant that planning approval has been obtained. <\/p>\n\n\n\n<p>Don\u2019t rely on a pre purchase building\ninspection to determine if planning approval has been obtained as the inspector\nis not authorised by the property owner to obtain past building permits and in\nany regard the time frames to obtain past permits is often well outside of the\ninspection requirements. <\/p>\n\n\n\n<p>Don\u2019t rely on the REIWA drafted Australian\nStandard Pre-purchase structural inspection clause to provide you with remedies\nagainst defective patios.
